Process Serving General

There are many types of process serving requirements through out Australia and it takes years of experience to figure out the does and don'ts of process serving. Because every state in Australia has their own legal system each process may have different rules of service. This takes years of experience to figure out and our Process Serving Man has this sorted, he is able to serve all manner of documents.

 

Please read the following information carefully!

  1. Personal Service
    Family Court documents require that the respondent, being the person named on the documents must be served personally and formally identified
  2. Current Address
    You must provide the current residential address and where possible a place of employment for the person being served.
  3. Provide Photograph
    For a smooth and effective service we require a photograph of the person being served (if available), if the respondent refuses service or to identify themselves the Process-Server is able to effect service by confirming their identity from the photograph provided.
  4. Urgent Service
    If your documents require service within seven days of being received by the Process-Server an urgent fee will be incurred. To ensure you have sufficient time for service please check your documents for times and dates.


Please read the following information carefully!

  1. Default Notice
    A default notice is a legal letter advising the borrower of payment defaults on their loan or mortgage. The notice is served the by personal service at the address on the Default Notice or by affixing the documents to the door of the security address.
  2. Who Requires Default Notice's
    Default Notice's are performed on behalf of a finance company or banks to legally notify a customer they are in arrears with their payments, and instruct them on what their arrears are and any further action that may be carried out.
  3. Current Address
    You must provide the current residential address and where possible a place of employment for the person you would like to have visited
  4. Urgent Service
    If you require the Field Call to be performed within seven days of being received by the Agent an urgent fee will be incurred.


Service Reporting

Please read the following information carefully!

  1. Attempts of Service
    Your Process-Server will make 3 attempts to serve the documents on the respondent for the fee charged.
    All attempts will be recorded then documents will be returned with a final report.
  2. Successful Service
    The Process-Server will contact you once service has been effected
  3. Affidavit of Service
    The Process-Server will provide to you a Sworn Affidavit of Service.
  4. Final Report
    On completion of service you will be provided to the billing address a report and all relevant documents.
